Mullet Champ Contest Terms of Service

1. Acceptance of Terms
By participating in the Mullet Champ Contest (hereinafter referred to as the "Contest"), you agree to be bound by these Terms of Service (hereinafter referred to as the "Terms"). Please read these Terms carefully before participating in the Contest. If you do not agree to these Terms, you may not participate in the Contest.

2. Eligibility
To be eligible to participate in the Contest, you must be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. By participating in the Contest, you represent and warrant that you meet these eligibility requirements.

3. Submission of Content
By participating in the Contest, you agree to submit one or more photographs of your mullet hairstyle (hereinafter referred to as the "Images") and a written story related to your mullet (hereinafter referred to as the "Mullet Story") (collectively, the "Content") through the Contest application. You represent and warrant that you have all necessary rights, permissions, and consents to submit the Content for the Contest.

4. Rights to the Content
By submitting the Content to the Contest, you grant Mullet Champ and its affiliates, subsidiaries, and partners (collectively, the "Mullet Champ Entities") a worldwide, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, create derivative works of, publicly display, and publicly perform the Content in connection with the Contest, the Mullet Champ brand, the USA Mullet Championship contests, and any other marketing or promotional activities related to the Mullet Champ Entities. You hereby waive any and all rights, claims, or interests you may have in the Content, including, but not limited to, copyright and moral rights.

5. Use of Content
The Mullet Champ Entities may use the Content for any purpose, including, but not limited to, marketing, promotion, and other services related to the Mullet Champ brand and the USA Mullet Championship contests. You acknowledge and agree that the Mullet Champ Entities may use your name, likeness, and the Content, in whole or in part, for such purposes without any further compensation or notification to you.

6. Release and Indemnity
By participating in the Contest, you release and hold harmless the Mullet Champ Entities, and their respective officers, directors, employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or in connection with the Contest, the Content, or your participation in the Contest.

7. General
The Mullet Champ Entities reserve the right, in their sole discretion, to modify, suspend, or terminate the Contest, or any part thereof, at any time and for any reason, without notice or liability to you. The Mullet Champ Entities also reserve the right to disqualify any participant at their sole discretion if they determine that a participant has violated these Terms or engaged in any fraudulent or unsportsmanlike conduct.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflicts of law principles. Any dispute or claim arising out of or relating to these Terms or the Contest shall be resolved by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

By participating in the Contest, you acknowledge and agree that you have read, understood, and accepted these Terms.

APPLICATION and CONSENT

I, the undersigned participant in this contest (“Contest”), hereby agree to abide by all Contest rules and to accept all judges’ rulings.

I agree to cooperate and speak with media and interviewers authorized by the Contest organizers regarding the Contest and I agree to grant and release all rights on my name, likeness, image, performance, victories and interviews before, during or after the Contest for use by the Contest organizers, their sponsors and licensees, and the other Released Parties (as hereinafter defined), in any and all media in perpetuity and for any and all purposes whatsoever. I also hereby waive, on behalf of myself, successors, heirs and assigns and anyone else claiming under me or on my behalf, all ownership or other property rights to my performance in the Contest and all related activities in perpetuity in all media whatsoever.

I acknowledge that travel, if necessary, to/from Contest, as well as my participation in Contest and any/all related activities, creates an inherent risk of exposure to COVID-19. I voluntarily assume all risks related to exposure to COVID-19 and agree not to hold contest Organizers, specifically USA Mullet Championships, the venue hosting the Contest and any companies involved in the Contest, liable for any illness or injury.

I expressly understand that entry and participation in the Contest and all related events and activities, including, without limitation, travel to the Contest and time spent in and around the area of the Contest, interviews with and possibly negative portrayals by the media, and my performance in the Contest, shall be at my own risk and I assume sole and complete responsibility and liability for all such risks.

I, on behalf of myself, my successors, heirs and assigns and anyone else claiming under me, hereby completely, irrevocably and unconditionally release and discharge all sponsors and licensees of the Contest; USA Mullet Championships; respective owners, directors, officers, agents, attorneys, employees, fiduciaries, parents, subsidiaries, divisions, partners, sponsors, licensees, joint ventures, affiliated business entities, predecessors, successors, heirs, and assigns, jointly and severally, from any and all claims, liabilities, damages, losses, expenses, suits, discrimination or other charges, demands, debts, liens, damages, costs, attorneys’ fees, prejudgment or other interest, grievances, injuries, actions or rights of action of any nature whatsoever now or in the future arising in any way out of or in connection with the Contest.

I fully acknowledge and understand that I do not have any right to participate in this Contest and related activities or contests and I am being permitted to participate at the discretion of organizers and in consideration of my execution of this document. I further acknowledge and agree that I understand all of the terms and conditions of this document and that I have been afforded an opportunity to have this document reviewed by counsel of my own choosing. I also understand that I will be given a signed copy of this document if I so request.

I am the Parent or Legal guardian of the person detailed above whose photos are being submitted and attest that all information is true. I am the copyright owner of the submitted photos.

I hereby grant permission to Mullet Champ, LLC, its owners, directors, collaborators, partners, officers, employees or representatives, to use photographs, video and/or digital images of my child for use in publicity, marketing, editorial, illustration, publishing, on social media or other lawful uses in connection with Mullet Champ, LLC. I agree that my name and identity: may be revealed in descriptive text, commentary, social media. promotion, commentary in connection with the use of such image(s). I authorize the use of these images indefinitely without compensation to me.
